Terms of Service - Kikuyu Kids

1. Legally Binding Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you (whether as a Student, Parent/Guardian, or Teacher) and Kikuyu Kids ("Platform", "we", "us"). By registering an account, accessing the App, or utilizing the website, you explicitly agree to be bound by these Terms. If you do not agree, you are strictly prohibited from using the platform.

2. The Educational Marketplace (For Teachers/Instructors)

Kikuyu Kids operates a digital educational marketplace allowing Independent Contractors ("Teachers") to publish language lessons for purchase by users. If you register as a Teacher, the following explicit financial and operational terms apply:

Revenue Share and Commissions: Kikuyu Kids deducts a strictly enforced twenty percent (20%) system commission fee on all gross revenue generated by your lessons. You will be credited the remaining eighty percent (80%) to your internal Wallet Balance.
Payouts: Wallet balances can be withdrawn to supported local payment methods (e.g., M-Pesa). Payout requests are subject to a standard processing and auditing period to prevent fraud.
Anti-Circumvention Policy: You strictly agree NOT to solicit students offline or attempt to conduct transactions outside of the Kikuyu Kids platform to avoid commission fees. The sharing of direct contact information (phone numbers, personal emails, social media handles) with students is strictly prohibited. Violation of this clause constitutes a material breach of contract and will result in immediate, permanent account termination and the forfeiture of all pending wallet funds.
KYC Verification: Teachers must submit true, accurate, and valid government-issued identification (National ID/Passport). Falsification of documents will result in legal prosecution.

3. Child Safety and Code of Conduct

Given the nature of our platform, the safety of minor students is non-negotiable. All users, specifically Teachers, must adhere to the highest standard of conduct.

No Inappropriate Content: The upload of sexually explicit, violent, discriminatory, or politically inflammatory content is strictly prohibited.
No Harassment: Bullying, harassment, or intimidation of any user will not be tolerated.
Zero Tolerance for Fraud: Any attempt to deceive users regarding lesson content, manipulate ratings, or execute unauthorized financial transactions will result in immediate termination and referral to law enforcement.

4. Intellectual Property Rights

All platform infrastructure, trademarks, and branding belong exclusively to Kikuyu Kids. By uploading lesson content (audio, images, text) to the platform, Teachers grant Kikuyu Kids a worldwide, non-exclusive, royalty-free license to host, display, and distribute said content strictly within the operational bounds of the platform.

5. Disclaimer of Warranties and Limitation of Liability

The platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. Kikuyu Kids shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of the platform, including but not limited to disputes between Teachers and Students.
